This presentation will discuss the most recent challenge to the ICWA in the Supreme Court decision Brackeen v. Halaand issued earlier this year. The panel will provide background and information on the distinct differences between Native American population, culture and its relationship with the Constitution as a political entity and not simply a minority classification. The panel will also discuss the impact of Brackeen and what the Court did and did not consider in affirming the authority of Congress to enact legislation regarding Federal Indian Tribes.
